Issues
Dear Mr. Gardner:
This morning I researched the zoning permit history of your property. The results are
indicated below.
• November 9, 1987 - LUP #87-288 issued for the construction of the dwelling at a
lake setback of 75'.
• January 26, 1990 — LUP #90-023 issued for the construction of 7' x 48' lakeside
deck at an average lake setback of 68'.

setback, but the property owner chose instead to build at a 75' lake setback. The
current Sawyer County Zoning Ordinance, Section 4.421 states in part, "Dwellings
constructed based on an average setback from navigable waters are considered to be
conforming to that setback." Therefore, I consider your existing dwelling with
attached deck, to be conforming to a setback of 68' from the lake. You do not have to
remove the deck or building eave to meet minimum ordinance requirements. Thus, I
believe the lake setback issues have been resolved in your favor.
I also verified that you do own both lots 15 and 16, Round Lake Retreat Subdivision.
It has been office policy that if a property owner owns two adjacent lots, and the
property owner has structures on both lots, that we do not consider the common lot
line to exist for lot line setback purposes. This policy will apply to you as I believe
you stated that you intended to build a garage on lot 16. If you take out a single
permit to build the dwelling addition (on lot 15) and the garage (on lot 16), the lot line
setback issue is no longer an issue. Note: You would still be required to meet the 30'
minimum setback from the opposite lot line.
