Dear Mr. and Mrs. Forbes:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application" -partially complete.
Please review the inspection report, read the summary on court decisions and complete
the request for additional information.
The variance application does not now include the "hallway" addition that you plan on
constructing onto the west side of the cabin. Once I know the actual dimensions of this
particular addition I will update the application and mail you a revised application for
your review. If you want to, you can send a copy of the inspection report to me with the
"hallway" addition dra�vn on the report, and I should then be able to prepare the final
variance application.
After you have received the revised application, and if you believe that you meet the
criteria for the requested variance(s), you should review the variance application for
correctness, si�n it, and return it to this office with a check in the amount of$2�0.00
made out to the "Sawyer County Zoning Administration" by Friday, January 7, 2000 for
hearings in February 2000.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your"Variance Application"will be reviewed at two public heari�gs.The first hearing � -
will held by the Town of Hayward at 7:00 P.M.,Tuesday,February 8,2000.You should
contact Jodi Longtine,Town of Hayward Clerk,at(715)634-4123(office)or 634-5188
(home)to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday,February 15,2000,in the Circuit Courtroom located in the Sawyer Counry
Courthouse.You or your representative should attend each hearing,especially the hearing
conducted by the Sawyer County Board of Appeals.Only the Board of Appeals can grant
the variance,the recommendation of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s)that you
have requested Therefore,you should consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present your facts to the
Board.
I believe that you should be prepared to address the following issue should the Board so
desire. The Board will probably insist that the cabin be relocated to 75'from the ardinary
high-water mark of the lake for the following reasons:
• The cabin is extremely close to the lake,
• The construction costs of the proposed addition will exceed 50%of the current
estimated fair market value of the cabin,and
• There is sufficient area available to relocate the cabin to 7S from the lake.
