Bock 2725 West 41 S` Avenue Gary, Indiana 46408 RE: Parcel :3.6, S 09, T 38N, R 06W, Town of Ojibwa, # W8730 State Highway 27/70: Property Inspection Dear Mr. And Mrs. Bock: Enclosed is a copy of the inspection report for your cabin based on my visit to your property today. I was told that you would like to construct an addition onto the east side of your cabin. The average river setback for your property is 75'. The entire cabin is located closer than 75' to the river. Construction activities closer than 7�' to the river would require the prior approval of a variance by the Sawyer County Board of Appeals. Therefore, any structural changes to the cabin would require a variance (i.e., additions off of the east, west and south sides, a second story addition, roof replacement etc.). The variance applicant must prove to the Board that only through the granting of a variance can "reasonable use" be made of the property. The "50% rule" applies in this situation as the cabin is a nonconforming structure - it is closer than 75' to the Chippewa River. The "50% rule" limits the cost of improvements to a nonconforming structure to less than 50% of the structure's current estimated fair market value (CEFMV). The Sawyer County Board of Appeals must approve a variance if the cost of these improvements will exceed 50% of the CEFMV. The CEMFV for the cabin is $ 10,500. Therefore, a variance would be required if the cost of the improvements would exceed $5,250. Again, you must prove to the Board that only through the granting of a variance can "reasonable use" be made of the property. The Sawyer County Board of Appeals seldom grants variances for construction activities closer than 40' to navigable waters. The only situation in which the Board mav grant such a varianc� is if a topographical hardship existed on the property that would prevent construction at a greater setback. However, even in this situation it is very doubtful if the Board would grant such a variance,as 40'is just too close to navigable waters for construction activities. � Based on my experience with the Board,especially afrer two State appellate court decisions on variances in 1998,if you applied for a vaziance to construct an addition off of either the west or east sides of the cabin,or a second story addition onto the cabin,I believe that the Board would give you one of two options: 1. Construct an addition off of the rear of the cabin,or 2. Relocate the cabin to at least 75'from the river and then you could construct whatever additions you desired onto the cabin. There is not a topographical hardship with your property that would prevent the relocation of your cabin to 75'from the river.
