Dear Mr. and Mrs. Albertin:
Enclosed is a copy of the inspection repor[for the above property and a completed
Variance Application. Please review the application, and if correct, sign it and return it to
this oFfice with a check in the amount of$250.00 made out to the "Sawyer Counry
Zoning Administration" by Thursday, April 1, 1999 for hearings in May 1999.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Bass La1ce at 630 P.M., Monday, May 10, 1999. You should contact Shirley
Miller, Clerk, Town of Bass Lake at(715) 634-2172 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, May 18, 1999 in the Circuit Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Boazd of Appeals. Only the Board of Appeals can grant
the variance, the decision oFthe Town of Bass Lake is advisory only.
It is your responsibility to convince the Boazd of Appeals to grant the vaziance(s) that you
have requested. Therefare, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
I am also enclosing an"Update on Law Governing the Granting of Variances." This is a
summary of two 1998 Wisconsin appellate court decisions regarding the granting of
variances. Essentially these two decisions state that:
• A variance should not be granted if the applicant already has reasonable use
of the property.
• A variance should only be granted if the applicant does not have reasonable
use of the property without the variance.
• The granting of variances should be the exception and not the rule.
You should be prepared to address the reasonable use of property issue if questioned by
the Board.

Notice is hereby given that on November 16, 1989, the Sawyer County Zoning
Board of Appeals approved the following application:
James A. Albertin et ux. Lots 15-20, Block 15, Community Beach
S 30, T 40N, R SW, Parcel -7.15-20. WD Vol 308 Records Pg 45
and Plat Envelope 36. Parcel size is 100' x 180' containing .41
acres. Property is zoned RR-2. Application is for the replace-
ment of an existing 24' x 24' garage with construction of a new
24' x 32' garage on the same location at a road setback of 41
feet to the centerline of Woodland Avenue. Town Board has approved.
Findings of Fact of the Board of Appeals: It is not for the convenience of
the owner; it is not a self created hardship; there would be no change in
tne use in the zone district; and it is not damaging to the rights of others
or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review the
legality of such decision within 30 days after the date of thic notice.
