On Thursday , March 26 , 1992 , the Sawyer County Zoning Board of Appeals denied and
approved your application for a variance on the following described real estate to
wit :
Lots 8-11 , Block 1 , Second Addition Victory Heights S 2 , T 39N ,
R 9W . Parcel -16 . 1 . 8-11 . WD Vol 332 Records Pg 383 and Plat En-
velope 27 . Parcel size is 209 ' x 303 ' /319 ' containing . 65 acres .
Property is zoned RR-2 . Application is for the construction of a
new 26 ' x 32 ' dwelling to replace an existing 22 ` x 30 ' cabin at a
waterline setback of 47 ' 6" from the normal highwater mark of Lac
Court Oreilles ; and at a cost exceeding 50� of the current fair
market value . Variance is requested as Section 4 . 49 ( 2) , Sawyer
County Zoning Ordinance , would require a waterline setback of � 69
feet as the average waterline setback was determined at 69 feet
from the normal highwater mark of the lake ; and Section 10 . 2 pro-
hibits structural alterations to nonconforming uses at a cost ex-
ceeding S0� of the current fair market value . Town Board has ap-
proved .
The Board of Appeals denied a waterline setback of 47 ' 6" . Approved a 60 foot
waterline setback and cost exceeding 50� of current fair market value .
Finding of Far_t of the Board of Appeals : For denial- It is strictly for the
convenience of the owner ; It is a self-created hardship ; It is not due to spe-
cial conditions unique to the property ; and it would be damaging to the rights
of others and property values . For approval- It is due to the location of the
garage and the blacktopped driveway .
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice .
