Variance Application
Dear Mr. and Mrs. Brauer:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request far additional information.
If you believe that you meet the criteria for the requested variance(s), you should review
the variance application for correctness, sign it, and return it to this office with a check in
the amount of$250.00 made out to the "Sawyer County Zoning Administration" by
Friday, May 7, 1999 for hearings in June 1999.
The "Application for Variance - Additional Information" must also be completely filled
out and returned with the Variance Application. Both documents together make up the
entire application that will be reviewed by the Sawyer County Board of Appeals. Failure
to return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Lenroot at 7:00 P.M., Monday, June 14, 1999. You should contact Lois
Miller, Clerk, Town of Lenroot, at(715) 634-8542 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, June 15, 1999 in the Circuit Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals.Only the Board of Appeals can grant
the vaziance,the decision of the Town of Lenroot is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s)that you
have requested.Therefore,you should consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present your facts to the
Board.
The"50%rule"applies in this situation as tbe cabin/deck is a nonconforming structure-
it is closer than 75'to Nelson Lake and the wetlands that are adjacent to the cabin. The
"50%rule°limits the cost of improvements to a nonconforming structure to less than
50%of the structure's current estimated fair market value(CEFMV). The Sawyer County
Board of Appeals must approve a variance if the cost of these improvements will exceed
50%of the CEFMV. The CEMFV for the house is$55,000. Therefore,a variance would
be required if the cost of the improvements would exceed$27,500.
The"50%rule"is based only on the cost of materials and labor to enclose and finish the
interior of the addition and the cost of materials and labor to enclose the garage.This
would also include any roof and foundation/crawlspace work.Costs for plumbing,
electrical,heating,painting,curtains,draperies etc.,are not included.It would appear to
me that you might be able to do this for less than$27,500.Therefare,I have not included
the"50%rule"on the variance.If there is any doubt as to the actual costs,you should
contact a builder and have the costs determined.If the costs will exceed$27,500,the
"50%rule"must be a part of this variance.
If you discover that the"50%rule"will be exceeded,you must notify this office by
Friday,May 7,1999,so that the application may be updated.In addition,you must also
provide this office with a written estimate of the material and labor costs for the addition
and garage.The construction cost estimates shall be in this office no later than Friday,
May 28,1999.You may also want to provide this information to the Town of Lenroot.

Dear Mr. Christman:
We are writing in follow-up to our conversation with you regarding our request
for a variance to build an addition to our cabin on Nelson Lake. Our cabin address is
15980 W Four Seasons Road in Lenroot Township, Hayward, Wisconsin. Our tax ID
numbers are as follows:
Cabin:(014-942-33 1105) NE 1/4 of NE 1/4, Sect 33, Twp 42, R 9W, Parcel .1.5
Lot: (014-942-33 1102) NE 1/4 of NE 1/4, Sect 33, Twp 42, R 9W, Parcel .1.2
As we discussed we are interested in building an addition to the west of our
cabin. We would like the addition to be 36' by 24' (including overhang) and the
attached garage to be 24' by 24'. This is 4 feet larger than what we originally
discussed but would help as we adapt the area in the addition to meet our needs.
This size of the living space would roughly equal what a second story would be. We
plan to move our septic tanks to accommodate the garage.
We are willing to sign the affadavit for the mound system as needed and also
join the properties so that the addition would meet all regulations except the 75'
wetland setback. As we discussed this westward location for the addition is being
proposed because of the well being located to the south, the lake setback to the north,
the natural drainage which occurs on the east side of our cabin, and the inability to use
second story space.
Enclosed is a letter from Dr. Trimble, Rheumatologist, who has managed and
monitored Martha's condition for 17 years. If there is any additional information
needed please advise.
