Mert Maki(Sawyer County Assistant Sanitarian)and I were on the property in question on November 6,2000. We measured lake(40')and road(114')setbacks as indicated in Variance 94-021. After side lot lines were measured and all other setbacks were taken into consideration,there is a potential building site of approximately 28'by 38'. We are not surveyors and we assumed all lot line measurements. Prior to any construction,the property should be professionally surveyed and then we will make our final setback measurements. There are several issues we have regarding the property. One issue in question,is that of a private sewage system. A certified soil test should be performed and an area for the septic system should be preserved prior to any construction of the dwelling. Another issue involves the setbacks from power line easements. There are several power lines crossing the property and any power line easement setbacks should be met. A discrepancy in the lot width is the final issue. We measured 84'between the stakes near the lake and the variance indicates 85'. Application is for the construc- tion of a 32'x 48' dwelling on a parcel with a lo[ width of 85 feet on a parcel containing 17,637 square feet at a waterline setback of 40 feet from the normal highwater mark of Sand Lake; and at a road setback of 114 feet from , Ehe centerline of STH 27/70. Variance is requested as Section 18.3, Sawyer County Zoning Ordinance, would require a lot width of 100 feet; Section 18.2 would require a par- cel size of 20>000 square feet; Section 4.49 would require a waterline setback of 75 feet from the normal highwater mark of the lake; and Section 4.21 (1) , would require a road setback of 130 feet from the centerline of a state trunk highway. Town Board has approved. The Board of Appeals approved the application as submitted. Findings of Fact of the Board of Appeals: It would not be for the convenience of the owner; It would not be the basis of economic gain or loss; It would not be a self-created hardship; There would be no change in the use in the zone district; It would not be damaging to the rights of others or property values; It would be due to special conditions unique to the property.
