Application is for the construction of a 20'x24' (22'x26' with eaves) 1 %2 story garage with loft storage area at a setback distance of 52'/65' from the centerline of County Hwy. E. Variance is requested as Section 4.21(2), Sawyer County Zoning Ordinance, would require a minimum setback distance of 75' from the centerline of this highway. The Town Board has approved the application. The Sawyer County Board of Appeals approved the application as follows: Allow 20'x26' (22'x28' with eaves); with removal of old storage shed; one year time limit. Findings of Fact and Conclusions of Law of the Board of Appeals: Hardship is present because of the uniqueness of the property and because applicant lives here year round. It is not contrary to the public interest. It would not be the convenience of the owner. It would not be the basis of economic gain or loss. It would not be a self-created hardship. Use additional paper for responses if required. Example responses are not related to any variance ever reviewed by the Board of Appeals. This forrr will bcome a part of your application packet and is to be returned to the Zoning Department by the variance application deadiine. Part 1 . Applicant supplied Information. . Current use of ur property & improvements - (e.g., "Property contains a residential home with a tached garage."). (`: / t G LY Describe the variance requested — (e.g., "Add a 15' x 20' addition to the side of the home."). Describe the effects on the property if the variance is not ranted — (e.g., "The addition is required for year-round living and protecting property value."). Describe alternatives to the reested variance such as other locations. desns and construction techniques. Attach a site map showin alternatives that you considered in each category below. a) Alternatives you considered that will comply with existing standards. If you find such an alternative, you may move forward with this option with a regular permit. If you rejected compliant alternatives, provide the reasons that you rejected them. (e.g., "Space is not available to expand in any other direction or location. House is too close to the side lot lines and the lake." . 2) No Harm to Public Interests. A variance may not be granted which results in harm to public interests. In applying this test, the Board of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Some, but not necessarily all of these considerations are: (1) Public health, safety and welfare, (2) water quality, (3) fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of property damages and (6) achievement of eventual compliance for nonconforming uses, structures and lots. Explain how the granting of this variance would not harm the public interests or how it may even enhance the public interests. 3) Unnecessary Hardship. An applicant may not claim hardship because of conditions which are self- imposed or created by a prior owner (for example, excavating a pond on a vacant lot and then arguing that there is no suitable location for a home.). Courts have also determined that economic or financial hardship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the parcel. You are applying for an "area variance.' An area variance relaxes a dimensional standard such as a setback, frontage, lot area, or height. For an area variance, unnecessar,y hardsh exists when compliance would unreasonablyprevent the owner from usinthe property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relaxation of the restriction are weighs against the limitations full compliance would impose on use of the property. Is unnecessary hardship present? ❑ Yes. Describe. ❑ No. A variance cannot be granted. 1kR 1d '1-5 We ccteG f{ %, / ¢G/,' kvre Glc'l"oR/'/16 Lol clll --`/aCc`l1G/ bllfv G' lt(1-G'e .'i 5/L[, /e!✓lcdce y'E /ti'ovh`o/t+/ d" .. (/- 7;'' i9/'a uJovLc Gr` lo !✓Gf{'e ``g oG[t-' ... /fUN'i, 4(1 -v Cv 7'`5 /aRrY Fo /yof- '"csl ciC t('.-5: ` 14ve u'ok!< UeRy /{4ad "o .;Pll ov2 onl F,"7` 1'( NarY-c a n',.,2 N`,r LT 4 i''i 1111` fC- o F t`Y-e. E Dear Mr. Yunker: Your application for a variance will be considered at a Public Hearing before the Sawyer County Zoning Board of Appeals on October 19, 2004 This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main Street, Hayward, Wisconsin. It is recommended that either you or a representative be present at the Hearing. A lack of information about the situation may result in unnecessary delay of a decision. Failure to appear may result in the denial of the application. If it is impossible for a representative to be present, please submit a written statement to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This statement should include a description of the general terrain; surrounding development; your proposed intentions; and the purpose of the request. Photographs of the property and/or buildings are requested. Explain the undue zoning hardship inflicted upon the owner by conforming to the required minimum regulation, which induced the variance request. Convenience and financial loss or gain does not constitute zoning hardship. Your application will come before the Town Board for their review. Please contact the Town Clerk, Shirley A. Miller, 7829N Evergreen Ave., Hayward WI 54843, 715/634- 8469, to obtain the time and confirm the date of the Town Board meeting for your attendance or Che attendance of your agent. , Office of Sawyer County Zoning Administration P. If you believe that you meet the criteria for the requested variance you should review the inspection report and application for correctness. If correct, sign the application and return it to this office with a check in the amount of$250.00 made out to the "Sawyer County Zoning Administration" by Friday, September 3, 2004 for hearings in October 2004. The "Application for Variance - Additional Information" must also be filled out and returned with the Variance Application. Both documents together make up the entire application that will be reviewed by the Sawyer County Board of Appeals. Failure to return both of the documents or failure to complete either document in its entirety will cause the variance application to be rejected by this office. The "Variance Application" will be reviewed at two public hearings. The first hearing will be held by the Town of Bass Lake at 6:30 P.M., Monday, October 11 , 2004. You should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town Hall) to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday, October 19, 2004, in the large courtroom located in the Sawyer County Courthouse. You or your agent should attend each hearing, especially the hearing conducted by the Sawyer County Board of Appeals. It is your responsibility to convince the I3oazd of Appeals to grant the variance that has been requested. Therefare, you should consider using any means at your disposal (i.e., photographs, drawings, a good verbal presentation, etc.) as you present the facts to the Board. Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to 4:00 P.M., Monday through Friday. Yours truly, G.eeCl,rG William A.
