On Tuesday, August 21, 2012 the Sawyer County Board of Appeals heard your request
for an extension of time on your variance that was granted in 2005 and extended for 5
years in 2007.
After some consideration the Boazd approved your request and lifted the time limitation to
make the approval perpetual as there will never be any changes to the conditions around
the property. There will no longer be a deadline on your variance.

We would like to remind you that your variance approval #OS-013 for the construction of
an dwelling with reduced highway setbacks and installation of a driveway with reduced
setbacks on the above-described property expires on July 19, 2007.
Please complete and submit the enclosed application for permit as soon as possible. The
application for use should include a drawing of the layout including dimensions and
setbacks. A certified soil test and sanitary permit must be obtained by a licensed plumber
as well.
If applications are not returned by July 19, 2007, it will be necessary to go through the
public hearing process again. The Sawyer County Zoning Office can issue citations,
including fines, if you construct without the proper permits. If you have decided not to
proceed with this project after all, please let us know.

RZ states Board will not approve of rebuilding on same footprint — must be 75' back from water.
Lotzer states deck would remain and would replace cabin behind deck. Discussion held on the 1,500
sq. ft. total listed in ordinance. WAC explains that it's only for additions to non -conforming
structures. This would be considered new construction. 1500 sq. ft. would not apply. Deck could not
remain where it sits. If building new 75' setback must be met. Discussion held on moving the whole
project back to meet 75' setback. KZ states surrounding properties were all built on wetland fill. AG
asks if Lotzer would consider tabling application and come back with a different configuration with
less requests for variances. Lotzer approaches and he and AG discuss location of driveway, parking,
location of existing cabin. RZ: Garage needs to be decreased in size to get square footage down.
Lotzer states he needs area for boats. KZ states he was on site — was also at town meeting. Talks
about size of cabin and location to wetlands. Would make more sense to tear down and start new.
Would like to see existing deck gone. Would cost hardly nothing to replace foundation. Dennis
Widiker, builder, was under impression they needed to build on existing foundation. Discussion held
on tabling application to redo plans for new dwelling with a 75' setback from lake.
AG motions to table to July public hearing to give applicant time to draw up new plans for new
construction in a different configuration.

NEW BUSINESS
1) Variance #05-013 Donald Birdsill — Request for extension. Asking for extension because of his
neighbor's property. Junk everywhere, vehicles, etc. AG states he has no problem extending,
neighbor's property needs to be cleaned up, devalues adjacent properties. Birdsill approaches and
presents photos of neighbor's property, owner is Michael Applebee. Zoning to inspect and will follow
UP.
AG motions to extend variance #05.013 for 5 years, expires 7/19/2012.

Dear Mr. Birdsill:
I have enclosed the following documents with this letter.
• Inspection Report (Map of Survey) for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
You should revie�� the inspection report and application for correctness. If correct, sign
the application and return it to this office with a check in the amount of $250.00 made out
to the "Savvyer County Zoning Administration" by Friday, June 3, 2005 for hearings in
July 2005.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Weirgor at 7:30 P.M., Tuesday, July 12, 2005. You should
contact Betty Brown, Town of Weirgar Clerk, at (715) 943-2390 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, July 19, 2005 in the large Courtroom located in the Sawyer County Courthouse.
You or your agent should attend each nearing, especially the hearing conducted by the
Sawyer County Board of Appeals. Only the Board of Appeals can grant the variance, the
decision of the Town of Weirgor is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as yotii present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration
dates to future variances. You should be prepared to discuss this issue with the Board
(i.e. , proposed date that construction would begin, any anticipated construction delays
that may be caused by the availability of contractors, excavators etc.).
