Request: Five-year renewal of conditional use pennit 19-019 for non-metallic mineral extraction
operation including rock crusher and asphalt plant. Originally approved April 15, 2002. Last
renewed April 16, 2019
Project History & Summary of Request
The renewal of CUP 19-019 is for the location of a non-metallic mineral extraction
operation including rock crusher and asphalt plant periodically. The property is 75 acres and
zoned A-2. Approximately 22 acres is currently active with no additional expansion proposed at
this time. The existing use is a gravel pit and woodland area. Surrounding use is forestry and
light residential. Nearest residence is 2037'. Complaints were received in 2020 for aspects of the
benn of the pit being too close to the property line. Also, that the gate was left open on a Sunday.
These issues were discussed with the Pit owner and have been rectified at this point. If pit
operations were to occur on a Sunday either citations or revocation of the CUP may occur.
The current hours of operations are 7 am — 9 pm Monday - Saturday. Gravel crusher and
asphalt plant 6AM-7PM, Monday-Saturday.
Financial assurance has been received for $8000 and expires February 22, 2023 in the
form of an irrevocable letter of credit from Chippewa Valley Bank (attached)
Additional information for Conditional Use Permits:
Substantial evidence means facts and infonnation, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use pennit. Any�ondition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant�nust demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are ar shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the pennit must be supported by substantial evidence.
