Ka Deputy Zoning&Conservation Adminis[rator S AWY E R COUNTY Conditional Use Permit Request STAFF REPORT Prepared B: Ja Kozlowski, Saw•er County Zonin & Conservation Administrator File: # CUP 22-011 Applicant: Darryl & Ruth Mast 6506N Old 27 Road Stone Lake, WI 54876 Property Location & Legal Description: Town of Sand Lake. Part of the SW '/ of the SW '/; 509, T39N, R09W; Parcel #026- 939-09-3301 ; 40 total acres; Zoned Agricultural One (A-1 ). Site Address 6506N Old 27 Road. Summary of Request and Project History: Pennit desired to build a 48 unit self-storage facility approximately 150' North of the South property line, on the East end of the front 40. The applicant's plan is to erect a 50' x 290' building. 48 individual units with the possibility of adding a second building in the future. This request is made as per Section 17.4 (B) (13) of the Sawyer County zoning Ordinance for a mini storage warehouse unit. This request is a little unique in that generally these types of structures are found within the G 1 District. However, The Sawyer County Zoning Ordinance does allow for these types of structures as a CUP within the A-1 District per current Ordinance. This CUP request would go with the property and if a CUP is approved it was also grant approval to erect the 2"d building with an application for a Land Use Permit within 5 years of CUP approval date. If a Land Use Pennit is not applied for within 5 years and erected within the permit time-frame the applicant will need to reapply for a CUP. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall -ant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must deinotzstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence.
