Part 2: Three-Step Test To qualify for your requested variance, you must demonstrate that your property meets the following three requirements. This is known as t/ze `Yhree-step test." 1) Unique Propertv Limitations. Unique physical limitations of the property such as steep slopes or wetlands that are not generally shared by other properties must prevent compliance with ordinance requirements. The circumstances of an applicant (growing family, need for a larger garage etc.) are not a factor in deciding variances. Nearby ordinance violations, prior variances or lack of objections from neighbors or the Town Boazd do not provide a basis for granting a variance. Do unique physical characteristics of your property prevent compliance with the ordinance? ❑ Yes. Where are they located on your property? Please show the boundazies of these features on the site map that you used to describe alternatives considered. (e.g., "There is a wetland area that extends around one side of the house and also behind the house."). - ' .>:_ _ r; . : . , :-.. ; - .. , !:/rq .cl! , ; . --- ❑ No. A variance cannot be granted. 2) No Harm to Public Interests. A variance may not be granted which results in harm to public interests. In applying this test, the Board of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Some, but not necessarily all of these considerations are: (1) Public health, safety and we►faze, (2) water quality, (3) fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of property damages and (6) achievement of eventual compliance for nonconforming uses, structures and lots. Explain how the anting of this variance would not harm the public interests or how it may even enhance the public interests. 3) Unnecessary Hazdshio. An applicant may not claim hardship because of conditions which aze self- imposed or created by a prior owner (for example, excavating a pond on a vacant lot and then azguing that there is no suitable location for a home.). Courts have also determined that economic or financial hardship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the pazcel. You aze applying for an "area variance.' An area variance relaces a dimensional standazd such as a setback, frontage, lot azea, or height. For an azea vaziance, unnecessary hardship exists when comnliance would unreasonably prevent the owner from usine the pronertv for a permitted purpose or would render conformitv with such restrictions unnecessarily burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relation of the restriction are weighs against the limitations full compliance would impose on use of the property. Is unnecessary hardship present? [Yes. Describe. t , _ ❑ No. A vaziance cannot be granted. i ,'7GtC MG 1 ' s A 'Ki Af i c. / r nlJ , ; wA d oP y ____ _--- _---- - --- - --- ___ _ _ _- -- -- G i o3 -- ' S O N a - i M E d W NE✓2 ,S 9 7 —28- — --- 'i s o k 2L- + o __ m os:-°--Q-.lz—t2' — o Ils Ths p a; ro, 5 ►d . r t a _9sLJ ,,'_ . a So u Er a d r,aE ------- - D u.r Id 1A v « - 61 a r 1 se._d.e_ Yf-IC ' i E 5 - ' S Nt 0+ b U2 D Ec'i VE 5 i s C kR i Es J- E h - _-__ ' - ' '7 l9 n/ ol NEyfJ — H ASE iue-c---1rL.cL✓ o_!_eS_'s . iMnoVmtN,__ Ilt 2o cQ LJo.cl bE 1, Sc. Yti ✓aK YLOUNd F)Ntl - - - + WE ' Ct v. lcl M O rI ' Ai _ i -- 'J6'E_Q__p__ Jd —E _ _ i_ ;_ o _ oN+ ; , uEd vAR , ok,, bs ; __ -- _ __ - ------- — l Nu- s n s _1- vrs ; bE 0 , a hE ___cr_c__Rls_Q__ as -I-1 Zs+ irlroo_--_ -o i l• A E, LnJ 11Ea lJ bY- 1G Gye.2 / k 'd'n/45 - i C ' 0 a _ :J 1 e 1G o oH - _ _ V E o b c b A c. i rJ-#-o -Oi L.i __ d + tiEE, +, 2q , o 1,t S ,dE wd . r b 1 S ' OM "" t i 11, A2 'Y OY-- /5 nl L • - ,om a _; yr. .t }ar .'f ulE Ca ' .s ne s >ls '1F •y,. a ,'nis .q,'qcN - o ra ,Z /n/c/kd d 1n A CoNJo Assoc 'a 'o ,✓ nl C EYt.l2 E l'►') O . d ac,k .t u 'va l.c Ca f. 0 I cI 6 iJ i' 2.
