the closest point would be 58'from the OHWM and would occur where there is already an e�cist-
ing deck.Variance is requested as Section 14.1,Sawyer County Shoreland Wetland Protection
Ordinance,would require the prior granting of a variance for any structure located closer than 75'
to the OHWM of the lake.The Town Board approved the application with additional comments.
The Board of Appeals approved the application with the following conditions: Shoreline
mitigation is to commence no later than this fall(2012); the front deck is not to exceed 8
feet when reconstructed;the side deck addition is not to exceed 42 inches;the 9'x 9'exist-
ing storage building is to be removed completety from property or relocated to a compliant
area;the new roof is to be at the same pitch as existing structure;a two(2)year time limit
to procure a land use permit;and silt fencing is to be installed during construction.
No Findings of Fact were given.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit CouR for Writ of Certiorari to review the legality of this decision within
30 days after the date of tivs notice.

Part 1: Applicant supplied information.
Current use of your property and improvements —
The property is used as a year-round home for myself, wife, children and
grandchildren.
Describe the variance requested —
Add a 10'3"x 13'4" kitchen — dining addition. As of now our family eats in a
make-shift dinning area in our living room because our kitchen is too small to
accommodate a table.
Describe the effects on the property if the variance is not granted —
If not granted, the family will be forced to continue to eat in our living room.
This will continue to create a situation where we are forced sometimes to eat in
shifts (holidays and family parties).
Describe the alternatives to the requested variance, such as other locations,
designs, and construction techniques —
There are no other plausible solutions or alternatives. If construction where to
go up, this would create a health care hardship. As my wife and I are getting up
in age, and we want our lifestyle to be more accommodating rather than less. A
second story on this building would be very impractical and would detract from
the appearance of the building from the lake. A two story building this close to
the lake would detract and not enhance its appearance form the lake view. If we
go to the south and use the existing bedroom and bathroom, the kitchen walls
would be torn down creating yet
another problem , the lost of a master bedroom and bath and destroying the
integrity of the site. Adding to the rear of the house just places the dinning area
too far from the kitchen.
Describe the impact on your property and adjacent properties, if the variance is
granted:
Currently a deck wooden deck is constructed in this area so the same
native vegetation, trees, and shrubs will not be disturbed. There will be no
impact on our area or the adjacent areas.
Part 2: Three-Step Test
1.Unique Property Limitations:
a. Yes-----Because of the present location of our home, in that it is
within 75 feet of the lake, a variance is required in order to meet our
needs. A dinning area to our kitchen location is the only possible
solution to our problem.
2. No Harm to Public Interest

a. The construction of this addition has no effect on either
neighbor.
b. It has no effect on the wetlands behind the house.
c. It dose not increase the overall foot print of the house and
the deck.
We are enclosing a portion of the deck area.
d. It does comply with the original 40' setback when the
cabin was built in 1938.
The lakeside of this addition is in line with the original cabin.
e. There is no removal of any trees or plant life for this project.
3. Unnecessary Hardship.
a. Managing large numbers of family and guest during
vacation times
and Holiday gatherings will be less burdensome with a larger
kitchen-dinning
area; therefore, an area variance would reduce this unnecessary
hardship.

County Zoning Board of Appeals on: Tuesday, July 17, 2012.
This hearing will begin at 6:00 P.M. at the Sawyer County Courthouse, 10610 Main,
Hayward, WI 54843. It is recommended that either you or a representative be present at
