Notice is hereby given that on Friday, July 17, 2015 the Sawyer County Zoning
Committee approved the following application:
Town of Edgewater- QP Investors, LLC c/o Bryan Nayes and Quality Propane Inc. Lot
� 3, being part of the NE 1/4 NW 1/4, S30, T 37N, R 9W; Parcel 2111. Doc 395391; CSM
Volume 33 page 213.Property has 4.4 acres and is zoned Commercial One.
Permit is desire for the location of commercial bulk fuel (propane) storage tanks and
utility shed (placement of tanks would be pending state approval). The Town Board has
approved the application with additional comments.
The Sawyer County Zoning Committee approved the application and is subject to state
approval.
Findings of Fact of the Zoning Committee: It would not be damaging to the rights of
others or property values; it would not create topographical problems such as run off,
drainage, erosion, flooding or vegetative cover removal.
PLEASE NOTE: This approval will exnire on July 17, 2016 if the permit is not
obtained by that date. A PERMIT TO CONSTRUCT OR USE OF LAND IS
REQUIRED.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may
commence an action in the Circuit Court for Writ of Certiorari to review the legality of
the decision within 30 days after the date of this notice.

The submittal described above has been reviewed for conformance with applicable Wisconsin Administrative Codes
and Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as defined in
chapter 101 .01 ( 10), Wisconsin Statutes, is responsible for compliance with all code requirements.
The following conditions shall be met during construction or installation and prior to use:
1 . SPS 305.73 ( 1 ) Liyuetied gas suppliers. General. (a) Pursuant to s. 101 . 16 (3g) (a), Stats., as of August 1 ,
2009, no person may engage in the business of tilling containers with liquetied petroleum gas that is
intended to be used direcdy from the containers as fuel, unless the person holds a license issued by the
department as a licensed liquefied gas supplier. (No record of Turnkey company license, obtain proper
license prior to operation /transfer ofi LP gas. (No license found in record for Quality Propane & Fuels so be
prepared to verify license to operate.)
2. SPS 340.31( 1 j The local fire department shall be notified of in5tallation with a "SBD-9656, Certificate of
lnstallation" within 10 business days of the installation. (Form is attached to a copy of this approval letter.)
3. SPS 340.32(2) Alterations to gas systems after commencement of operation reyuire plan submittaf and
inspection per this section. (Future tank instalis reyuire plan submittal.)
4. SPS 340.34 (2) b The installer shall notify lnspector Duane A Leetch (715) 559-8817 at least tive (5)
business days prior to the start of construction ro arrange for inspection.
5. NFPA 58, 5.7.4.2 Containers over 4000 gallon shall be eyuipped in accordance in uccordance with
5.7.4.2(A) through G and Table 5.7.4.2)
6. NFPA 58, 5.7.8. 1 Shut-off valves shall be in a readily accessible rosition less than 6 ft above ground level
or have extension handles, stairs, ladders or platforms for easy access or remote operation.
7. NFPA SS, 5.�.8.5 Container inlet and outlet connections on ASME containers of more than 20(x) gallon
water capacity shall be labeled to designate whether they communicate with vapor or liyuid space.
S. NFPA 58, 5.9 Pipe, hose, fittings and valves shall meet the requirements of this section
9. NFPA58, 5.9. 1 .4 Piping that contains liquid LPG between isolated valves shall include hydrostatic reliefs.
10. NFPA 58, 6.4.5.2 Loose or piled combustible material or weeds and long grass shall be tieparated from
containers by a minimum of 10 feet.
11 . NFPA 58, 6.5.3 Point of transfer (load/unloading) locations shall meet the requirements of this section
including distance reyuirements per Table 6.5.3. (Separate Bobtail / transport transfer points on site inside
fenced area shown.)
12. NFPA 58, 6.9.3. 1 Piping shall be installed in accordance with ASME / ANSI B 31 .3, or Section 6.9.
(ASTM D 2513 poly piping shall be recommended with acceptable fitting per section 5.9.5 installed per
6.9.4.

Subject: Question regarding your land use permit application
Bryan,
In reviewing your land use permit application for approval I noticed on the plot plan that your proposed fence will be
constructed kind of close to the easement road,however you did not indicated the distance from the fence to the road.
The department considers the setback distance of a 66'easement road the same as if it is a 66'town road and we
consider fences as being"structures." The fence will need to be a minimum of 63'from the centerline or 30'from the
right of way of the road. Even though you indicated the road as being the driveway and ending where you indicated,the
easement road is a surveyed and mapped 66'road of record and therefore you must maintain the minimum setback
distances from it.
Please adjust your placement of the fence accordingly and contact me with the actual measurement distance.I'm
placing your application on hold until I receive this information.

Dear Bryan;
Your application for a Conditional Use will be considered at a Public Hearing before the
Sawyer County Zoning Committee on Friday,July 17,2015.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the application may result in unnecessary delay of a decision. Failure
to appear may also result in the denial of the application.
If it is impossible for you or a representative to be present, please submit a written
statement directed to James Bassett, the Chairman of the Zoning Committee addressed to
this office. The statement should include your proposed intentions or purpose of the
request and a description of the general terrain and surrounding development. Indicate
how the proposal would not be contrary to the public interest. Photographs of the
property and surrounding area are encouraged.
Your application will also go before the Town Board for their review. Some
townships also have a Planning Commission. Please contact the Town Clerk Natalie
Clemens; 715-354-7747 to obtain the day and time of the Planning Commission and
Town Board meetings for your attendance or the attendance of your agent.
PLEASE NOTE: If approval is granted, a permit is required. Applications can be
obtained from the Zoning Office.
