Rezone requested for RR-2 Request: Permit desired for Conditional Use specified under Section 17.3 (B) (3&13) of the Sawyer County Zoning Ordinance. Recreational Service-oriented use such as sport shop or in the same general character in the opinion if the Sawyer County Zoning Committee as specified in subsection (3) in conjunction with a shrub/tree nursery as specified in subsection (13). This specific request is for a Feed & Seed Shop which according to the Sawyer County Zoning Administrator would be as the same general character or clearly incidental to other uses as specified above. Project History & Summary of Request The applicant(s) are requesting a Conditional Use Permit for a Feed & Seed Shop. The applicants initially approached the Zoning Office a few months back to see what routes were needed in order to permit this type of use. At that tiine, it was advised to the applicants that in order to operate this type of Feed & Seed Shop that they would need to rezone the property or a portion of the property and also be granted a CUP for this type of use. The current use of the property is a single-family dwelling with storage buildings and also selling of firewood under a pennitted use in the F-1 zone district for "production of forest crop". This is a very rural part of the County with little to no other dwellings within a % mile radius. The applicant has already submitted for a Land Use Pennit far the construction of a new building on the property but are waiting for final approval to establish this new use on the property. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use pennit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed inust be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the ap�lication and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence.
