Request: Permit desired for a 30' x 40' accessory structure, height of 17', on the other side of a
Town road (Fender Road) subject to section 4.26 (2) & (3) of the Sawyer County Zoning
Ordinance.
The construction of a single accessory structure on an adjacent parcel of land that are divided by
a Public Roadway and defined as one contiguous tract of land by deed or survey map will also
require Conditional Use Approval.
Project History & Summary of Request
The applicant is requesting to build a 30' x 40' accessory structure on the back side of Fender road
across a Town road from where the primary dwelling is located. The current primary dwelling and
detached garage is located on the Barber Lake side of Fender Road. The proposed accessory
structure would not be able to fit on the lake side portion due to setback requirements of the road
and sewer system and would increase impervious surfaces on the lake side. The proposed
accessory structure would be located approximately 380' from the lake and would meet all other
setback requirements including impervious surface requirements per the land area. See attached
maps included in this packet. Pat Brown from the Sawyer County Zoning & Conservation
Department was also onsite for this property to verify wetland setbacks for the proposed structure.

Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.

If an applicant agrees to ineets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit inust be supported by substantial evidence.
