During the inspection the average lake setback was determined to be 53'from the ordinary high-water mark of the lake. A flag was set at this distance from the lake,4'behind the cabin.Construction activities closer than 53'to the lake would require the prior approval of a vaziance by the Sawyer County Boazd of Appeals. The 50%current estimated fair market(CEFMV)rule applies in this situation as the cabin is a nonconforming structure—it is closer than 75'to the lake. The"50%rule" restricts the cost of improvements to a nonconforming structure to no more than 50%of the CEFMV of the structure. The 50%CEFMV for the dwelling is$8,950. Construction costs exceeding$8,950 would require the prior approval of a variance by the Sawyer County Board of Appeals. The costs related to the 50%CEFMV are the costs of materials and labor to construct a foundation,enclose an addition and to finish the interior of the addition(i.e.,sheet rock). Costs related to plumbing,heating electrical,window and floor coverings etc.,are not related to the 50%CEFMV. As we discussed,your next step is to determine the construction costs for the screen porch addition to be located behind the cabin(at least 53'from the lake). If the costs would be less than$8,950,I believe that there is a reasonable chance that you would be able to construct this addition and connect it to the reaz of the cabin without a variance. Also,as we discussed,a permit was required for the replacement deck as the deck is larger than 100 square feet. I am enclosing a permit application for the deck. The permit fee is$75.00.
