Your Petition for Variance of the code section(s) noted above has been reviewed.
Departmental Action: CONDITIONAL APPROVAL
The code section petitioned requires POWTS treatment, holding and dispersal components shall be located as to
provide the minimum horizontal setback distances as outlined in Table 83.43-1 as safety factors for public health,
waters of the state and structures in the event of component failure. Table 83.43-1 requires an exterior subsurface
treatrnent tank or holding tank to be a minimum of 5' from any building.
The variance requested is to allow the construction of a garage to be 21" from the existing holding tank.
The intent of the code section petitioned is to protect the structure in the event of component failure.
The pelitioner subtnitted a notarized SB-9890 application form including additional page(s) of supporting
documents and/or plans.
Reviewer's Comments:
1. In reviewing the petition, it was noted that ihe request is similar to other petitions accepted by this department.
2. Based on the precedent established by the previous petitions, this pelition for variance is being processed as
permitted by Wisconsin Statute s. 101.02(6)(g), and Comm 3.
All of the petitioner's statements included on the variance applicafion form, any other documents submitted to the
Department, and all conditions of approval, if any, listed below shall be canied out This variance is specific to the
subject petition and cannot be used for any addilional modifications.
Conditions of Approval:
• The garage slab shall be constructed of reinforced concrete.
• The owner states that the holding tank is not in a "drivable area." The edge of the holding tank should be
marked with posis or in some other manner to ensure there will be no vehicular h�affic on top of the tank.

• The sidewalk may cross the holding tank, but access ports,manhole covers and vents must remain
unobstructed. All code required locks must be in place.
In granting this approval the Division of Safety&Buildings reserves the right to require changes or additions
should conditions arise making them necessary for code compliance.As per state stats 101.12(2), nothing in this
review shall relieve We designer of the responsibility for designing a safe building, structure, or component.

Dear Mr.Iverson&Archer,
Our land use permit secretary asked me to verify setbacks for your proposed garage on
Maple Terrace.
You are in violation of the following:
Section 11.3 1.)No valid land use permit$396.50
Section 11.18 4.)Septic Sewer setbacks $335.00

I will not issue the two citafioos if I receive your immediate cooperation. Please stop all
construction immediately!!! You have poured the garage slab without a valid land use
permit and the slab setback to the sepric tank is+21"(Code is 5').
I called your home on Tuesday June 6��2004,3:00 p.m.and talked to Chad. He stated that
you got permission from our office to pour the slab. I discussed these matters with Debbie,
� (land use sec.)she in no way told you to start construction without a land use permit.
Unfortunately,you are misinformed somehow.
It appeaKs that you have two options to correct this matter before we will issue the land use
permit for the garage.
1.) Move the garage slab to meet all code setbacks.
2.) Petition the State Department of Commerce for a variance for a+21"inch
setback from the garage to the septic tank,Code requires 5'ft.
Please refer to my inspection report and cross-section diagrams. You will be required to
petition the state for an"after the fact"variance at any of the Commerce Office listed in
the petition form. I discussed these matters with Patricia Shandorf,Commerce Hayward
office. I suggest that you process the application with her.(Phone 715-634-7810).
A final reminder,cease and desist construction,process the petition for variance,provide
our office with the variance approval so that we can process and approve your land use
permit.
